Abstract

The study sheds light on the requirement of Islamic adherence in personal status matters, given its significance in various aspects. It addresses the matter of the requirement of Islam and its impact on personal status issues by examining the extent of compatibility between Jordanian Personal Status Law No. 15 of 2019 and Islamic jurisprudential rulings regarding the requirement of Islam. The study concludes that there is alignment between the provisions of Jordanian Personal Status Law under study and Islamic jurisprudential rulings concerning the requirement of Islam, although there are differences in opinion regarding this requirement in the case of ruling (judgment) and guardianship. The study recommends that the Jordanian legislator should take these considerations into account to impart a legitimate character to all the provisions of the law under examination.
