Abstract

It is known that the approach of Islamic law is based on bringing interests to the creation and removing evil form them, to achieve the intent of Sharia for them to preserve their religion, themselves, their mind, their offspring and their money.

Since the purpose of legitimate purposes to bring interests and prevent evil, it was necessary to achieve and find this destination in all aspects of the practical life of man religious, social, economic, political and legal, for the good of people in their recent and future life. This study aims to extract the practical and realized interests of the litigants and the court through the procedures stipulated in the Jordanian Shari’a Procedures Law No. (11) for the year 2016, which guarantees to them that interest. This study talks about the interest in the legal articles related to the methods of appeal provided by the law of objection, appeal and appeal to the Supreme Islamic Sharia Count and retrial as a model for the study.This study shows the potential of the interests sponsored by the law in many of its articles such as lifting the embarrassment of creation and simplify the life to them and saving the effort and time spent in the procedures stipulated by law, which requires the commitment of the parties and the court and not to infringe to reach the desired interest of its articles. The study also shows that the legal procedures stipulated in the appeal section of the ruling lead to ensure justice and not to miss the interest of any of the parties (litigants) during the appeal against the verdict against one of them.
