The purpose of the fighting and the role of conflict and weighting in clarifying the rulings of prisoners according to the scholars of principles of Jurisprudence: An applied study

Abstract

This study aims to highlight the purpose of combat in Islam and the laws which govern prisoners according to the Quran and the Sunnah, as well as to clarify any apparent contradictions between texts in the Quran in this regard. Sunnah refers to the traditions and practices of the Islamic prophet, Muhammad, that constitute a model for Muslims to follow. The study also shows that the reason Muslim scholars were in conflict over how prisoners must be punished was due to their differences on how to clarify any religious texts which seemed to contradict themselves, in regards to laws governing hostages. Applying any rules which are not yet defined and which may seem to contradict one another other would be going against the Prophet’s noble Sunnah. Applying these rules in their clear meaning- according to the objectives of Islamic law- guarantees that religious extremists will not manipulate any of these religious texts for their own benefit.
