Abstract

Objectives:
This research explores the significance of the statements of the Companions in Islamic jurisprudence, particularly their ijtihād in cases where no explicit Qur’anic or Sunnah text exists. It examines whether their rulings are binding, their status among legislative sources, and whether their ijtihād holds precedence over later scholars' interpretations. The study also clarifies scholarly disagreements and their jurisprudential implications.

Methodology:
The research adopts descriptive, inductive, and analytical approaches, providing both a general and detailed understanding of the topic. It analyzes scholarly differences on the authority of qawl al-Ṣaḥābī and its legal impact.

Results:
TThe findings revealed that the statements of the Companions fall into different categories and ranks. Some of their statements were unanimously agreed upon by the Companions and were classified as matters of ijmāʿ (consensus), making them binding without dispute. Others were subject to disagreement among them; the majority of scholars held that such statements are not authoritative. Each group has its own evidence supporting its stance.

Conclusions:
The research concludes that the ijtihād of the Companions is authoritative, as they directly witnessed the Prophet’s actions and understood revelation’s context.
