Abstract

Deposit the Testimony one of the means of proof in Islamic law, and it falls under the section of testimonies, so it can be considered aproven evidence, and testimony is a legal argument that shows the truth and does not require it, but the judge must rule according to it. Because if it fulfills its conditions; It shows the right, and the judge is commanded to judge the truth, and it shows the people's need for testimony to prove their rights. Due to the large number of disputes and discounts, corruption of receivables and fraud, and other matters that disturb the right holder, as testimony is resorted to when it is not possible to establish a case for knowledge in every dispute, and Deposit the testimony attention is considered one of the important topics in testimonies, which were dealt with by the masters of the Maliki in their books, They gave her live examples and facts that were revealed to the purposes and regulations of Sharia, and this research deals with the subject of depositing testimony, its concept, its controls, and its motives, in addition to presenting contemporary examples, highlighting its authority through modern means of communication, and the extent to which it can be activated in the circle of family reform.
